Terms of Use (End User License Agreement)
These terms are an agreement between you and Roberto Neamtu (“we”, “us”), the developer of the TracePDR mobile application (the “App”). By downloading, installing or using the App you agree to these terms. If you do not agree, do not use the App.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal or business purposes, in accordance with these terms and the usage rules of the store you obtained it from (the Apple App Store or Google Play). The App is licensed, not sold.
2. Restrictions
You may not: copy, modify or create derivative works of the App; rent, lease, sell, sublicense or redistribute it; remove any proprietary notices; or decompile, reverse-engineer or disassemble it, except to the extent that applicable law expressly permits this despite this restriction.
3. Your data and your responsibilities
- Your content is yours. Estimates, customer details, photos and prices you enter stay on your device and belong to you. How the App handles data is described in our Privacy Policy.
- Accuracy of quotes. The App calculates estimates from the prices, markups, fees and tax rates that you configure. You are responsible for checking every estimate and invoice before you send it, and for the prices you charge.
- Tax and legal compliance. The App is not tax, accounting or legal software and does not give professional advice. You are responsible for applying the correct taxes and for meeting any invoicing, record-keeping and consumer-protection rules that apply to your business.
- Your customers’ privacy. You are responsible for handling your customers’ personal data lawfully, including under the GDPR where it applies.
- Backups. Your data exists only on your device unless you back it up. Keep regular backups; we cannot recover lost data.
4. Free plan and TracePDR Pro subscriptions
- Free plan. Without a subscription you can create up to 3 new estimates in total (duplicating an estimate counts as creating one; deleting one does not give it back). Opening, editing, pricing, sharing and backing up estimates you already have is never limited.
- TracePDR Pro removes the monthly limit. It is sold as an auto-renewing subscription, monthly or yearly, at the price shown in the App before you buy, including any taxes the store applies.
- Billing and renewal. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. The subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before that. You can cancel or change plans at any time in your App Store or Google Play account settings. Cancelling stops future renewals; you keep Pro until the end of the period you paid for.
- Free trial. Where a free trial is offered (currently 7 days on the yearly plan, for eligible new subscribers), the subscription starts automatically at the regular price when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial ends when you buy a subscription.
- Refunds. Purchases are processed by Apple or Google, and refund requests are handled by them under their policies. This does not affect any rights you have under mandatory consumer law, including in the EU.
- Price changes. If the price changes, the store will tell you in advance and, where required, ask for your consent before the new price applies.
- If your subscription ends, your data stays on your device and remains fully accessible; only the monthly limit on new estimates applies again.
5. Third-party services
Subscriptions are processed by Apple or Google and managed through RevenueCat, Inc., as described in our Privacy Policy. Optional VIN decoding uses the free vPIC service of the U.S. National Highway Traffic Safety Administration. Vehicle information it returns is provided by that service “as is”; we do not guarantee its accuracy or availability. Apps you choose to share PDFs or backups with are governed by their own terms.
6. Updates
We may release updates that add, change or remove features. We are not obliged to provide updates, maintenance or support, but where the law requires us to provide updates needed to keep the App working as described, we will.
7. Disclaimer
To the extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Nothing in these terms limits any rights you have as a consumer that cannot be excluded by contract, including your statutory rights under EU and Romanian law regarding digital content that does not conform to its description.
8. Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, lost profits, lost revenue, lost data or business interruption arising from your use of the App, including losses from quotes or invoices produced with it. Our total liability for any claim relating to the App is limited to the amount you paid for it, including subscriptions, in the 12 months before the claim. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, for damage caused intentionally or through gross negligence, or to any other liability that cannot be limited by law.
9. Termination
This license remains in effect until terminated. It ends automatically if you breach these terms. You can end it at any time by deleting the App. On termination you must stop using the App and delete it from your devices. Sections 3, 7, 8, 11 and 12 survive termination.
10. Terms for Apple App Store users
If you obtained the App from the Apple App Store, the following also applies:
- This agreement is between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- The license above is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We are solely responsible for any maintenance and support of the App. Apple has no obligation to provide any maintenance or support services.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms (for example, your wireless data service agreement) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of it Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
11. Governing law and disputes
These terms are governed by the laws of Romania. If you are a consumer resident in the European Union, you also keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of Romania or of your country of residence. The European Commission’s online dispute resolution information is available at consumer-redress.ec.europa.eu.
12. General
If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms; the effective date above shows the latest version, and continuing to use the App after an update means you accept it. These terms, together with the Privacy Policy, are the entire agreement between you and us about the App.
